1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the website sunenergyexperts.com.au (the “Site”) and the purchase of products or services through the Site. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms.

3. Interpretation and Definitions

• “Customer”, “you” or “your” means the person ordering or purchasing through the Site.
• “We”, “us”, “our” means Sun Energy Experts.
• “Products” means the solar panels, inverters, batteries, packages, and any other goods listed on the Site.
• “Services” means installation, maintenance and related services offered via the Site.
• “Order” means your purchase of Products and/or Services via the Site.

4. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not use the Site in any way that:

• infringes the rights of any other person;
• is unlawful, fraudulent or harmful;
• interrupts or interferes with the Site, or attempts to gain unauthorised access.

5. Orders and Payment

• All orders placed via the Site are subject to acceptance by us. We may refuse, cancel, or delay an order at our discretion (for example, if there is an error in the pricing or product availability).
• Payment for Products and/or Services must be made via Stripe (or other payment methods specified).
• You warrant that the payment method you use is yours or authorised by the owner.
• Prices shown on the Site are in Australian Dollars (AUD) and include (or exclude) GST as specified.
• We may apply surcharges or fees only to the extent permitted by law.

6. Supply of Products & Services

• We will deliver Products to the address you provide. You must ensure the delivery address is correct and accessible.
• For Services (such as installation), we will agree with you a schedule and scope. You must provide access, safety compliance and necessary approvals.
• Risk in Products passes to you on delivery (or on pickup if applicable). Title remains with us until full payment is received.
• We endeavour to meet specified delivery or installation dates, but we are not liable for delays outside our control (e.g., shipping delays, weather, site conditions).

7. Consumer Guarantees & Returns

• Our Products and Services come with guarantees under the Australian Consumer Law (ACL). Nothing in these Terms restricts your rights under the ACL. Lawpath+1
• If a Product is faulty or does not meet a consumer guarantee, you may be entitled to a repair, replacement or refund.
• For change of mind or non-fault returns, our policy is set out in our Refund & Returns Policy (see section 10).

8. Intellectual Property

• All content on the Site (text, graphics, logos, images, software) is owned or licensed by us and is protected by copyright and other intellectual property laws.
• You may view and print content for personal/consumer use only. You must not reproduce, distribute, modify or create derivative works without our express permission.

9. Limitation of Liability

• To the maximum extent permitted by law, we exclude all liability for any loss or damage you suffer arising from your use of the Site, Products or Services (including indirect or consequential loss).
• Our liability for any breach of consumer guarantees that cannot legally be excluded is limited, at our option, to: (a) the replacement or repair of the Products; or (b) the payment of the cost of replacement or repair.

11. Privacy & Data Protection

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms.

12. Dispute Resolution & Governing Law

• These Terms are governed by the laws of the state of [insert state, e.g., New South Wales] and the Commonwealth of Australia.
• You submit to the non-exclusive jurisdiction of the courts of that state and Australia.
• If there is a dispute, you agree to attempt: (i) internal resolution via our customer support; (ii) if unresolved, mediation; (iii) litigation as a last resort.
